P.A.C. Privacy PolicyAs part of its normal operations, P.A.C. collects and, in some cases, discloses your User Information. This User Information is submitted only to bid winners, listing buyer, or listing seller for the purpose of finalizing transactions. This Privacy Policy describes the information P.A.C. collects about you and when and why that User Information may be disclosed. As described below, some of your User Information is disclosed to third parties and used by P.A.C. and third parties. By accepting the User Agreement, you expressly consent to such use and disclosure of your User Information.1. Types of Information Collected by P.A.C.In the online registration form, you are required to provide your full name, company name, full street address, phone number, email address and a password. If you choose to bid, buy or sell on the P.A.C. Web Site, P.A.C. may collect additional information including billing addresses and other billing and tracking information from checks or money orders. If you send P.A.C. personal correspondence such as email or letters, or if other users or third parties send P.A.C. correspondence about your activities or postings on the P.A.C. Web Site, P.A.C. may collect such information into a file specific to you.2. P.A.C.'s Use of User Information.User Information is used by P.A.C. to improve marketing and promotional efforts, to statistically analyze usage to improve content and product offerings, and to customize content and layout. P.A.C. believes these uses allow it to improve the P.A.C. Web Site and better tailor it to meet its users' needs. P.A.C. may use your email address, or your mailing address or phone number, to contact you regarding administrative notices from time to time. P.A.C. uses User Information in activities on the P.A.C. Web Site, to resolve disputes, troubleshoot problems and enforce its User Agreement. At times, P.A.C. may look across multiple users to identify problems or resolve disputes, and may evaluate your User Information to look for users using multiple passwords or aliases.3. P.A.C.'s Disclosure of User Information.P.A.C. does not sell or rent any information about you to a third party. P.A.C. cooperates with all law enforcement inquiries and with all third parties to enforce their intellectual property or other rights. P.A.C. automatically sends an email to both the seller and winning bidder containing each party's respective registration information. All recipients of such User Information agree to restrictions on how they use and disclose such User Information, as described below.Unfortunately, due to the existing regulatory environment, P.A.C. cannot ensure that all of your private communications and other User Information will never be disclosed in ways not otherwise described in this Privacy Policy. For example, third parties may unlawfully intercept or access transmissions or private communications or certain circumstances. Additionally, P.A.C. can (and you authorize P.A.C. to) disclose your User Information to law enforcement or other government officials as P.A.C., in its sole discretion, believes necessary or appropriate. Therefore, although P.A.C. uses industry standard practices to protect your privacy, it cannot and does not promise that your User Information or private communications will remain private.4. Your Use of Others User Information.As a listing seller or listing buyer on the P.A.C Web site, you will be sent via e-mail the registration information of the winning bidder or the seller, as the case may be. By entering into P.A.C.'s User Agreement, you agree that, with respect to User Information of others that you obtain through the P.A.C. Web site or through a P.A.C.-related communication or P.A.C.-facilitated transaction, P.A.C. hereby grants to you a license to use such User Information only for: (1) P.A.C. Web Site related communications that are not unsolicited commercial messages, (2) third party services offered in connection with P.A.C. Web Site transactions, and (3) any other purpose that such user expressly opts into after adequate disclosure of the purpose(s). In the case of (2), you must give users an opportunity to remove themselves from your data base and a chance to review what User Information you have collected about them. In addition, except as defined herein, under no circumstances may you disclose User Information about another user to any third party without the consent of such other user after adequate disclosure. Without limiting the foregoing, you are not licensed to add a P.A.C. user, including those users who have purchased an auction item from you, to your mail list (e-mail or physical mail) without their express consent after adequate disclosure.5. Third Party Use of User Information.This Privacy Policy only addresses the use and disclosure of the User Information P.A.C.'s collects from you. To the extent that you disclose your User Information to other parties, whether they are bidders, buyers or sellers on P.A.C. Web Site or other sites throughout the Internet, different rules may apply to their use or disclosure of the personal information you disclose to them. P.A.C. cannot and does not control the privacy policies of third parties, and you are therefore subject to the privacy customs and policies of third parties. Ask questions before you disclose your personal information to others.6. Reviewing and Changing Your User Information.Once you register, you will be able to review and change much of your User Information, including your email address, your name, company, address, city, state, zip code, country, primary phone number, secondary phone number, fax number, and your password. P.A.C. will retain in its files User Information you have requested to remove in some circumstances, such as to resolve disputes, troubleshoot problems and enforce its User Agreement. Because P.A.C. backs up its systems, you should not expect that all of your User Information will be completely removed from P.A.C's databases in response to your requests. You must promptly update your User Information if it changes.7. Control Your Password.You are prohibited from disclosing your password to any third parties or sharing it with any third parties. If, despite the foregoing, you lose control of your password, you may lose substantial control over your User Information and may be subject to legally binding actions taken on your behalf. Therefore, if your password has been compromised for any reason, you should immediately change your password.8. Security.P.A.C. uses efforts to safeguard the confidentiality of your User Information such as requiring very restricted administrator access to the P.A.C. Web site server. You should be aware, however, that there is no such thing as "complete security" on the Internet. P.A.C. CANNOT BE RESPONSIBLE FOR THE ABSOLUTE SECURITY OF THE P.A.C. WEB SITE, AND YOU RELEASE P.A.C. FROM ANY LIABILITY RELATED TO ANY BREACH OF SECURITY OF THE P.A.C. WEB SITE CAUSED BY ANY THIRD PARTY.9. General.This Privacy Policy is incorporated into and subject to the terms of the P.A.C. User Agreement.
